Welcome to NoseDesk. These terms set out the basis on which you may use the Service. Please read them carefully — they include important disclaimers about AI-assisted suggestions and about your responsibility for handling fragrance materials safely.
1. Agreement to these terms
By accessing or using NoseDesk (the “Service”) — including the website, the BrainDesk assistant, the formula workspace, and any related tools — you agree to be bound by these Terms & Conditions. If you do not agree, please do not use the Service. If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization to these terms.
2. What NoseDesk is
NoseDesk is a workbench for independent perfumers. It helps you search supplier materials, organize formulae and versions, take linked notes, and receive AI-assisted suggestions through BrainDesk. The Service is provided to support your own creative process; it does not replace your professional judgment, formal training, or independent verification of any material, supplier, or regulation.
3. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. You are responsible for keeping your account credentials secure and for all activity that occurs under your account. Please notify us promptly at [email protected] if you believe your account has been compromised.
4. Acceptable use
You agree not to misuse the Service — including by attempting to disrupt or reverse-engineer it, accessing it through unauthorized means, infringing others’ intellectual property, uploading unlawful or harmful content, or using it to violate any applicable law. We may suspend or limit access where we reasonably believe these terms are being breached.
5. Your content and data
You retain ownership of the formulae, notes, and other content you create in NoseDesk. You grant us a limited license to store and process that content only as needed to operate and improve the Service for you. We do not sell your content, and we do not use your private formula data or BrainDesk queries to train third-party AI models.
6. AI assistance is guidance, not advice
BrainDesk and other AI-assisted features generate suggestions that may be incomplete, inaccurate, or unsuitable for your specific use. They are creative starting points, not professional, safety, regulatory, medical, or legal advice. You are responsible for independently verifying any recommendation before acting on it.
7. Safety and regulatory responsibility
Fragrance and aroma materials can be hazardous and are subject to regulation. You are solely responsible for handling materials safely and for complying with all applicable standards and limits — including IFRA standards, supplier safety data sheets (SDS), and local laws — before creating, testing, wearing, selling, or distributing any product. NoseDesk does not certify the safety, legality, or fitness of any material or formula.
8. Intellectual property
The Service, including its software, design, branding, and content we provide, is owned by NoseDesk or its licensors and is protected by intellectual-property laws. These terms do not grant you any right to use our trademarks or branding without our prior written permission. Catalog and material data may be owned by the respective suppliers or sources from which it originates.
9. Third-party services and links
The Service may reference or link to third-party suppliers, websites, or tools. We do not control and are not responsible for third-party content, products, or practices. Your dealings with any third party are solely between you and that third party.
10. Service availability and changes
We are continually improving NoseDesk and may add, change, or remove features at any time. We may also suspend or discontinue the Service, in whole or in part, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Service.
11. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
12. Limitation of liability
To the maximum extent permitted by law, NoseDesk and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising from or related to your use of (or inability to use) the Service — including any reliance on AI-assisted suggestions or on material, supplier, or safety information surfaced through the Service.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these terms or if we reasonably believe it is necessary to protect the Service or other users. Sections that by their nature should survive termination — including ownership, disclaimers, and limitation of liability — will continue to apply.
14. Changes to these terms
We may update these terms from time to time. When we do, we will revise the “Last updated” date shown with these terms, and material changes will take effect when posted. Your continued use of the Service after changes take effect constitutes acceptance of the revised terms.
